1. Who you are dealing with
These terms are between you and [LEGAL ENTITY NAME, PLLC], doing business as Xenith Health (“Xenith Health,” “we,” “us”), located at [STREET ADDRESS], Amarillo, TX [ZIP]. Xenith Health is a physician-led medical practice. Our physicians are licensed by the Texas Medical Board. Their names and credentials are listed on our About page.
2. Not for emergencies
Our services are not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not use the website, consult form, email, or text to report urgent symptoms.
3. Where we provide telehealth
Telehealth services are available only to patients who are physically located in Texas at the time of each visit. You must be 18 or older. We may ask you to confirm your location before and during care.
4. A physician decides whether to treat
Requesting a consult or paying a fee does not guarantee that you will receive a prescription or any particular treatment. A licensed physician reviews your health history and evaluates you by live audio-video visit or another method permitted under Texas Occupations Code Chapter 111 before any prescription is written. The physician may decline to prescribe, may require laboratory testing, or may require an in-person visit. Prescriptions are written only when the physician determines treatment is medically appropriate for you.
5. Medications and the pharmacy
Xenith Health does not manufacture, compound, or dispense medications. Prescriptions are filled by an independent, state-licensed pharmacy, currently King Compounding Pharmacy, [PHARMACY STREET ADDRESS], Amarillo, TX [ZIP], Texas pharmacy license [TX PHARMACY LICENSE #]. Medication costs are billed separately from membership fees unless a plan expressly states otherwise.
Compounded medications, including compounded semaglutide and tirzepatide, are prepared by a licensed compounding pharmacy to a physician’s prescription. Compounded drugs are not FDA-approved. The FDA does not review them for safety, effectiveness, or quality before they are dispensed, and they are not generic versions of, or the same as, any FDA-approved brand-name product. Individual results vary.
6. Memberships, fees, and cancellation
- Memberships are billed monthly in advance and continue until cancelled. The initial physician consult is billed separately and renews annually.
- You may cancel by giving at least 30 days written notice to hello@xenithhealth.com. Fees for months already billed are not refunded.
- Full terms, including what is and is not refundable, are in the Refund & Cancellation Policy, which is part of these terms.
- Prices are in U.S. dollars. We do not bill health insurance. You may use HSA or FSA funds where your plan allows; eligibility is between you and your plan administrator.
- Before any card is charged for a recurring membership, we will show you the price, billing frequency, and cancellation terms and ask for your express agreement.
7. Your responsibilities
- Give complete and truthful information about your health, medications, and allergies.
- Follow dosing instructions and report side effects promptly to your care team.
- Keep your contact information current so we can reach you about your care and billing.
- Use the patient portal and booking tools only for yourself or someone you are legally authorized to act for.
8. Privacy
Website data is handled under our Privacy Policy. Medical information is handled under our Notice of Privacy Practices. By using telehealth you also agree to the Telehealth Consent.
9. Website content
Content on this site is for general information and does not create a physician-patient relationship. That relationship begins when a physician evaluates you. The site, its design, text, and images are owned by Xenith Health or its licensors and may not be copied without permission.
10. Third-party services
Appointment booking and the patient portal are provided by Boulevard. Payment processing is handled by our merchant services provider. Those services have their own terms, which apply to your use of them.
11. Disclaimers and limitation of liability
The website is provided “as is.” To the fullest extent permitted by law, Xenith Health is not liable for indirect, incidental, or consequential damages arising from use of the website. Nothing in these terms limits our professional obligations to you as a patient or any liability that cannot be limited under Texas law.
